STUDENT POLICY AGREEMENT

GENERAL1.01.The term “Student” as used throughout this Agreement, includes the individual enrolled in or intended to be enrolled in a lesson program offered by Backbeat, that individual’s parent(s) or guardian(s) and the heirs or executors of any of them.
1.02.This Agreement shall remain in effect until terminated in accordance with the provisions of this Agreement.
ATTENDANCE2.01.If the Student arrives late for a lesson that lesson will not be extended but will end at the regularly scheduled time.
2.02.A lesson that the Student misses or cancels will not be rescheduled. If the Student is unable to attend a private lesson, the Backbeat instructor will prepare and send a short video lesson to the Student. If the Student is unable to attend a group class or rock band rehearsal, no make-up lesson or video lesson will be provided.
2.03.If the regularly scheduled instructor is not available for a lesson for any reason, Backbeat will provide a substitute Backbeat music instructor for the Student. If Backbeat cannot provide a substitute, the Student will receive a refund proportionate to the monthly fee.
REGISTRATION AND PAYMENT3.01.Lessons must be paid for monthly in advance. All pre-authorized payments (“Pre-Authorized Payments”) will be charged or cashed monthly at the beginning of each month.
3.02.In the event that there are insufficient funds in an account to cover Pre-Authorized Payments, including cheques made out to Backbeat, and Backbeat incurs fees (“Additional Fees”), Backbeat is entitled to charge all Additional Fees to the Student. Full payment of Additional Fees must be received by Backbeat within ten (10) days of notification.
3.03.In the event that a failed payment is not remedied and/or repaid prior to the Student's second lesson of the month, Backbeat reserves the right to terminate the Student's registration effective immediately.
3.04.No refunds will be given for lessons the Student misses or lessons that are cancelled by the Student.
TERMINATION BY STUDENT4.01.The Student may terminate this Agreement by giving written notice to Backbeat before the 15th day of the month prior to the month in which the termination is to become effective. Termination will be effective as of the 1st day of the month following the month in which notice was given.
TERMINATION BY BACKBEAT5.01.Backbeat may terminate this Agreement and cease the Student’s participation in lessons immediately for any reason whatsoever. Such termination will be effective immediately. Backbeat shall not be liable for any damages or loss claimed by the Student.
5.02.Without limiting 5.01. it is a policy of Backbeat that the following acts or omissions of the Student will result in termination without refund: failure to abide by the terms and conditions of this Agreement, repeated failure to attend lessons (three consecutive weeks), theft, vandalism, use of inappropriate language, fighting, defiance or disrespect towards Backbeat staff and/or students.
MATERIALS AND INSTRUMENTS6.01.The Student must attend each lesson with a functioning instrument and all necessary materials, such as books, unless otherwise instructed by Backbeat.
6.02.Backbeat accepts neither responsibility for the condition of the Student’s instrument(s) nor any liability for damage that is sustained by the Student’s instrument(s) while it is on Backbeat property.
PRIVACY POLICY7.01.Personal information gathered by Backbeat is kept in confidence. Access to the Student’s private information is only given to Backbeat staff and volunteers as required to perform the services for which the information was gathered or to perform the services Backbeat was contracted to provide.
Entire Agreement; Amendments in Writing8.01.This Agreement, including appendices, constitutes the entire agreement between the Parties. Any and all previous agreements between the Parties, written or oral, express or implied, are terminated and cancelled.
8.02.Any modification of this Agreement must be in writing. If any amendment to this Agreement is not in writing, it shall have no effect and shall be void.
